Last Updated September 21, 2026
These Terms of Service (“Terms”) govern your access to and use of the Virginia Trade School website, located at www.virginiatradeschool.edu, and any related online services, platforms, or digital resources made available by the School (collectively, the “Website”). Please read these Terms carefully before using the Website.
By accessing or using the Website in any manner, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must immediately discontinue use of the Website and refrain from accessing any content or services provided therein.
As used throughout these Terms, the words “School,” “we,” “us,” and “our” refer to Virginia Trade School, its employees, officers, agents, and authorized representatives. The words “User,” “you,” and “your” refer to any individual or entity who accesses, browses, or otherwise uses the Website, whether as a visitor or as a registered user.
1. Acceptance of Terms
Your access to and use of the Website constitutes your unconditional agreement to be bound by these Terms, as well as the Virginia Trade School Privacy Policy, which is incorporated herein by reference. These Terms form a legally binding agreement between you and Virginia Trade School.
The School reserves the right, in its sole discretion, to modify, amend, or update these Terms at any time and without prior notice. When changes are made, the School will update the Effective Date displayed at the top of this document. Your continued access to or use of the Website following the posting of any revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically to remain informed of any updates.
2. Eligibility
The Website is intended for use by individuals who are at least thirteen (13) years of age. By accessing or using the Website, you represent and warrant that you meet this minimum age requirement. Users who are under the age of eighteen (18) must have obtained the consent of a parent or legal guardian prior to using the Website or submitting any personal information, where such consent is required by applicable law.
By using the Website, you further represent and warrant that all information you provide to the School — whether through inquiry forms, application submissions, registration processes, or any other means — is accurate, current, and complete. You agree to update such information promptly if any changes occur. The School reserves the right to suspend or terminate access for any user who provides false, misleading, or incomplete information.
3. Use of the Website
The Website is provided to facilitate access to educational information, institutional resources, and enrollment services offered by Virginia Trade School. Your use of the Website is subject to the following conditions:
3.1 Permitted Uses
Subject to your compliance with these Terms, you are permitted to use the Website for the following lawful purposes:
- Browsing publicly available content and informational materials published by the School;
- Submitting inquiries, requests for information, or contact messages to the School;
- Accessing program descriptions, course offerings, schedules, and related academic information;
- Completing and submitting enrollment applications and admissions materials; and
- Using any features, tools, or online services expressly made available to users by the School.
3.2 Prohibited Use
You agree that you will not use the Website for any of the following purposes, and that such uses are strictly prohibited:
- Engaging in unauthorized scraping, data mining, harvesting, or automated collection of any content or data from the Website;
- Posting, transmitting, uploading, or distributing any content that is harmful, defamatory, obscene, abusive, threatening, harassing, fraudulent, or otherwise unlawful;
- Attempting to gain unauthorized access to any portion or feature of the Website, or to any other systems or networks connected to the Website, including through hacking, password mining, or any other illegitimate means;
- Impersonating any person, entity, or organization, or falsely representing your affiliation with any person or entity;
- Using the Website for commercial solicitation, advertising, or promotional purposes without the express prior written consent of the School;
- Uploading, transmitting, or introducing any malware, virus, Trojan horse, worm, or other disruptive or harmful code or technology;
- Interfering with or disrupting the integrity, security, or performance of the Website or its servers and networks; or
- Violating any applicable local, state, federal, or international laws, regulations, or ordinances in connection with your use of the Website.
The School reserves the right to investigate and take appropriate legal action against any party that, in its sole discretion, is determined to have violated the foregoing prohibitions, including without limitation reporting such conduct to law enforcement authorities.
4. Intellectual Property
All content appearing on or accessible through the Website — including, without limitation, text, articles, course descriptions, curriculum materials, photographs, images, illustrations, graphics, logos, trademarks, service marks, icons, audio clips, video clips, data compilations, and software — is the exclusive property of Virginia Trade School or its respective licensors and is protected by the copyright, trademark, trade dress, and other intellectual property laws of the United States and applicable international conventions.
No content on the Website may be reproduced, duplicated, copied, sold, resold, modified, published, distributed, displayed, performed, transmitted, or otherwise exploited for any commercial purpose without the express prior written permission of Virginia Trade School or the applicable rights holder.
Subject to your compliance with these Terms, the School grants you a limited, non-exclusive, non-transferable, revocable license to access and view Website content solely for your own personal, non-commercial informational purposes. This limited license does not include the right to download, print in bulk, or otherwise reproduce content beyond what is necessary for personal reference. Any rights not expressly granted herein are reserved by the School.
Virginia Trade School’s name, logo, and all related marks, names, and slogans are trademarks of Virginia Trade School. You are not permitted to use any such marks without prior written consent from the School.
5.User-Submitted Content
To the extent that the Website permits users to submit content — including, without limitation, inquiry forms, enrollment applications, uploaded documents, written communications, or other materials (collectively, “Submitted Content”) — by submitting such content you hereby grant Virginia Trade School a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, store, and process your Submitted Content solely for the purpose of operating the Website and fulfilling the School’s educational, administrative, and operational functions.
By submitting any content through the Website, you represent and warrant that: (a) you own or otherwise have the legal right to submit such content; (b) the Submitted Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, or any other rights of any third party; and (c) the Submitted Content does not contain any material that is unlawful, defamatory, obscene, or otherwise objectionable.
The School does not claim ownership of your Submitted Content and does not assume any obligation to maintain, store, or return such content beyond what is required by applicable law or the School’s policies.
6. Enrollment and Registration
The submission of an application, inquiry, or expression of interest through the Website does not constitute an offer of enrollment or admission to any program offered by Virginia Trade School, nor does it create any obligation on the part of the School to admit or enroll the applicant. Enrollment is contingent upon the satisfactory completion of the School’s admissions process, fulfillment of all applicable program prerequisites and requirements, availability of space within the requested program, and agreement to all applicable enrollment terms and fee obligations.
Users are solely responsible for ensuring the accuracy and completeness of all information submitted through the Website in connection with any application or registration process. The School reserves the right to rescind any offer of enrollment or registration made in reliance upon information that is subsequently found to be false, misleading, or incomplete.
Nothing on the Website constitutes a binding contract for enrollment unless and until a formal enrollment agreement has been executed in accordance with the School’s established admissions and registration procedures.
7. Fees Payments and Refunds
Tuition rates, program fees, registration charges, and all other applicable costs associated with enrollment at Virginia Trade School are established and communicated through separate enrollment agreements, program documentation, and official fee schedules, which may be updated from time to time at the School’s discretion. Nothing on the Website constitutes a binding representation regarding the finality or permanence of any stated fee amounts.
To the extent that the Website facilitates online payment transactions, such transactions are processed through one or more third-party payment processors. Virginia Trade School is not responsible for errors, failures, processing delays, or security incidents arising from the acts or omissions of third-party payment processing providers. By initiating a payment through the Website, you agree to the applicable terms and conditions of the relevant payment processor.
Refund eligibility, procedures, and timelines are governed exclusively by the Virginia Trade School Refund Policy, which is incorporated into these Terms by reference and made available through the School’s administrative offices and, where applicable, through the Website. Users are encouraged to review the Refund Policy carefully prior to submitting any payment.
8. Third-Party Links and Services
The Website may contain hyperlinks to external websites, online platforms, or third-party services that are not owned, operated, or controlled by Virginia Trade School (collectively, “Third-Party Sites”). The School may also integrate or reference third-party tools, applications, or service providers in connection with the Website’s functionality.
Virginia Trade School makes no representations or warranties regarding the content, accuracy, reliability, availability, or practices of any Third-Party Sites. The inclusion of any link to a Third-Party Site does not imply endorsement, sponsorship, or recommendation by the School of that site, its content, its operators, or any products or services offered therein. Users access Third-Party Sites entirely at their own risk and are encouraged to review the terms of service and privacy policies applicable to any Third-Party Site they visit.
The School shall not be liable for any harm or damages of any kind arising from your use of, or reliance on, any Third-Party Site or third-party service accessed through or referenced on the Website.
9. Disclaimers of Warranties
THE WEBSITE AND ALL CONTENT, SERVICES, AND MATERIALS PROVIDED THROUGH OR ON THE WEBSITE ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIRGINIA TRADE SCHOOL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the Website will be available without interruption, error-free, or free from technical defects;
- Warranties that the Website or its servers are free of viruses, malware, harmful components, or other destructive elements; and
- Warranties regarding the accuracy, completeness, timeliness, or reliability of any content, information, or materials appearing on the Website.
Some jurisdictions do not permit the exclusion of certain warranties. To the extent that such exclusions are not permitted under applicable law, the foregoing disclaimers shall apply to the maximum extent permitted.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIRGINIA TRADE SCHOOL, ITS BOARD OF DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE TO ANY USER OR THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE; (B) ANY CONTENT, INFORMATION, OR MATERIALS OBTAINED THROUGH THE WEBSITE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) ANY OTHER MATTER RELATING TO THE WEBSITE — EVEN IF VIRGINIA TRADE SCHOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In the event that the foregoing limitation of liability is found to be unenforceable or inapplicable, the total cumulative liability of Virginia Trade School to you for any and all claims arising out of or related to these Terms or your use of the Website shall not exceed the greater of: (i) one hundred dollars ($100.00 USD); or (ii) the total amount actually paid by you to Virginia Trade School during the twelve (12) month period immediately preceding the event giving rise to the claim.
The limitations set forth in this Section reflect a reasonable allocation of risk between the parties and are a fundamental element of the basis of the bargain between you and Virginia Trade School.
11. Indemnification
You agree to indemnify, defend, and hold harmless Virginia Trade School and its board members, officers, employees, contractors, agents, licensors, and affiliates (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, judgments, fines, penalties, costs, and expenses — including reasonable attorneys’ fees and court costs — arising out of or in connection with:
- Your access to or use of the Website;
- Your breach or alleged breach of any provision of these Terms;
- Any content you submit, post, transmit, or otherwise make available through the Website;
- Your violation of any applicable law, regulation, or ordinance; or
- Your infringement or misappropriation of any intellectual property, privacy, or other rights of any third party.
The School reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with the School’s defense of such matter. This indemnification obligation shall survive the termination or expiration of these Terms and your use of the Website.
12. Privacy
Your use of the Website is also governed by the Virginia Trade School Privacy Policy, which describes how the School collects, uses, discloses, and protects personal information submitted by users. The Privacy Policy is incorporated into these Terms in its entirety by this reference and forms an integral part of the agreement between you and the School.
By using the Website, you acknowledge that you have read and understood the Privacy Policy and that you consent to the collection and use of your information as described therein. The Privacy Policy is available on the Website at www.virginiatradeschool.edu/privacy-policy. If you have questions or concerns regarding the School’s data practices, please contact the Legal/Compliance Office using the contact information provided in Section 16 of these Terms.
13. Governing Law and Dispute Resolution
These Terms, and any dispute, claim, or controversy arising out of or related to these Terms, your use of the Website, or your relationship with Virginia Trade School, shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any choice-of-law or conflict-of-law rules or provisions that would cause the application of the laws of any other jurisdiction.
Any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state courts of the Commonwealth of Virginia or, where federal jurisdiction applies, in the United States District Court for the applicable federal district in Virginia. By using the Website, you hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection that the venue of such proceedings is improper or inconvenient.
Nothing in this Section shall preclude either party from seeking injunctive or other equitable relief in any court of competent jurisdiction where necessary to prevent irreparable harm.
14. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, void, or unenforceable for any reason — whether in whole or in part — such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if it cannot be so modified, it shall be severed from these Terms. The invalidity or unenforceability of any such provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect as if the invalid or unenforceable provision had never been included.
15. Entire Agreement
These Terms of Service, together with the Virginia Trade School Privacy Policy and any applicable enrollment agreements, tuition schedules, refund policies, program-specific terms, and other official School documentation expressly incorporated herein by reference, constitute the entire and complete agreement between you and Virginia Trade School with respect to your use of the Website and supersede all prior and contemporaneous understandings, agreements, representations, warranties, negotiations, and communications — whether written or oral — between you and the School regarding such subject matter.
No waiver by the School of any breach or default of these Terms shall be deemed a waiver of any subsequent breach or default, and shall not affect the other terms of these Terms. The section headings used in these Terms are for convenience only and shall have no legal or contractual effect.
